Ostar is committed to respecting your privacy rights and personal data at all times, so we have taken all necessary measures to keep the information you provide us safe. You can trust that Ostar will make good use of this information and take all necessary precautions to keep your information private and secure.

The use that Ostar makes regarding your personal data (email, name, telephone number, age, gender, signature, address, tax identification number, CURP), sensitive data (racial or ethnic origin), financial and asset information (confidential credit card or banking information) (hereinafter referred to as “Personal Data”), is based solely on providing the services that you have requested from Ostar; notifying you about new services or products related to those already contracted or acquired; informing you about changes in them; preparing studies and programs that are necessary to determine consumption habits; conducting periodic evaluations of our services in order to improve their quality; evaluating the quality of the service we provide and, in general, to fulfill the obligations we have contracted with you.

PRIVACY NOTICE

In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter “The Law”), we inform you as follows:

Ostar Hotel Group and its affiliated, controlled and related companies (hereinafter “Ostar”), indicating for the purposes of this Privacy Notice the address located at London 130, Col. Juárez, Del. Cuauhtémoc, C.P. 06600, Mexico City, will be responsible for the Personal Data provided by the individuals to whom such data correspond (hereinafter “the Holder”), for itself or for any of the commercial companies that are its controllers, subsidiaries or affiliates.

The handling of the Personal Data of the Owner that have been made available to Ostar in any form or circumstance, may be carried out in accordance with these terms and conditions, so from this moment it is understood that the Owner gives his consent for such handling. If you do not agree to provide your Personal Data, please leave this website immediately.

The Owner of the Personal Data guarantees that they will never be false under any circumstances and that they will inform Ostar of any modifications they may undergo to keep the information updated.

The Personal Data information that is collected by Ostar directly from the Holder with their full consent will be used as described below, but not limited to: a).- identify you, b).- locate you, c).- communicate and contact you, d).- send you information, e).- statistical information, as well as its transmission to third parties through any means permitted by law. The use of Personal Data will be directly related to the relationship you have with Ostar as a consumer.

The temporality of the handling of the personal data of the Owner will depend on the legal relationship held with Ostar, as well as on the obligations required by current legislation and competent authorities. In all cases, the information will be kept only for a reasonable time.

The information that is provided to Ostar will be properly safeguarded, preserved and protected, with the appropriate technological and physical means in order to prevent its loss, misuse, alteration, unauthorized access, and theft. Only those authorized by Ostar will have access to the information, whether they are employees, service providers or business partners, who have committed to keeping the information under strict confidentiality and security measures; for this reason, Ostar’s employees will sign a Privacy Policy, and suppliers have signed agreements where the confidentiality of the information is agreed upon.

In case the Personal Data protected are required by an authority of any kind, whether by legal process, to respond to any claim or legal actions, or to protect the rights of Ostar, its clients and the public; this Personal Data will be made available to them within the strict compliance with the Law.

The Data Subjects will have the right to request access, rectification, cancellation or opposition of their data, through a written request addressed generically to Ostar Hotel Group, at the address: Londres 130, Col. Juárez, Del. Cuauhtémoc, C.P. 06600, Mexico City, from 9:30 to 19:00 hours, on business days, as well as through a request made to our telephone 50800658 or the email comunicacion@ostar.com.mx, having to have a receipt of acknowledgment.

Ostar will respond to requests from the data subject, as long as none of the exceptions contained in the Law are met, and the requester complies with the requirements contained in Article 29 of the Law described below:

I.- Indicate the name of the Holder and address or another means to communicate the response to their request;

II.- Attach the documents that certify the identity or, where applicable, the legal representation of the Holder;

III.- The clear and precise description of the Personal Data in relation to which one of the aforementioned rights is sought to be exercised, and

IV.- Any other element or document that facilitates the location of Personal Data, that is, to which company of the group they were provided, the person to whom they were provided or the area of the company to which the person to whom the data were provided belongs.

In case sensitive, patrimonial, or financial data of the Owner is transferred to any third party, except in the case that they are transferred to any authority by law or requirement, or in compliance with the legal relationship entered into with the Owner and Ostar, the Owner will be notified by any means, whether written, telephone, electronic, optical, auditory, visual or any other means that technology allows now or in the future.

In the event that Ostar needs to use your Personal Data for purposes other than those agreed upon or agreed upon within the legal relationship that it has with the Owner, the Owner will be notified in writing, by telephone, electronically, or by any optical, sound, visual, or other means that technology now or in the future allows, and will explain the new uses it intends to give to that information in order to obtain your authorization.

With this Privacy Notice, the information holders are duly informed of the data collected from them and for what purposes, accepting the terms contained that were developed in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties.

Ostar reserves the right to modify this policy to adapt to legislative or jurisprudential novelties as well as industry practices. In such cases, the changes introduced will be announced on this page with reasonable notice before they are put into practice.

Similarly, the User accepts that all the information added by him or that is obtained through his access to ostar.com.mx will be susceptible to being compiled and stored in a database, which will be owned by Ostar.

The User agrees that by entering their information on ostar.com.mx, they give their express consent referred to in Article 76 bis of the Federal Consumer Protection Law so that Ostar can disseminate and transmit the information inserted in the Database to other providers or competent authorities that require it.

Similarly, the User gives their express consent to receive information of a commercial or advertising nature from Ostar, in accordance with articles 16, 18, and 18 bis of the Federal Law on Consumer Protection.

Ostar declares and the User accepts that Ostar will not be responsible or exercise any form of control over the links to different pages, portals, etcetera of third parties unrelated to Ostar that could be contained in ostar.com.mx.

PROHIBICIONES

It is prohibited to use this site in order to commit an act that may constitute an infringement, crime, defamation or slander against Ostar, or upload files containing viruses.

The present Privacy Notice, as well as the overall handling of the law by Ostar, is governed by the current and applicable legislation in the United Mexican States, any controversy that arises due to its application must be resolved before the competent Jurisdictional Bodies in Mexico City, Federal District.
